Yes. An at-home paternity DNA test can be performed without the mother’s DNA sample. Testing the alleged father and child can still provide an accurate paternity test result.

Including the mother’s DNA sample may assist the laboratory during the analysis, but her participation is not required to determine whether an alleged father is biologically related to a child.

The mother’s participation in the DNA test and whether her consent is required to test a minor are two different issues.

Can I do a paternity test without the mother’s consent? 

Yes. The mother’s consent may not be required when another person has legal authority to consent to DNA testing on behalf of the minor. When an alleged father does not have the legal authority to consent to testing for a child under 18, permission from the child’s mother or legal guardian may be required before testing.
